1. Acceptance

By installing or using Promptory ("the Extension"), you agree to these Terms of Service. If you do not agree, please uninstall the Extension.

2. Description of Service

Promptory is a proprietary browser extension that helps users save, organize, and insert AI prompts into supported platforms (ChatGPT, Claude, Gemini, etc.). Optional cloud sync is available via Google sign-in.

3. User Content

You retain full ownership of all prompts and content you create in the Extension.
If you share a prompt to the Public Library, you grant other users a non-exclusive right to view and use that prompt. You can request removal at any time.
You are solely responsible for the content of your prompts. Do not share prompts containing illegal, harmful, or infringing content.

4. Acceptable Use

You agree not to:

Use the Extension to distribute malware, spam, or harmful content
Attempt to access other users' data or bypass security measures
Abuse the Public Library by posting spam, offensive, or illegal content
Use automated tools to mass-scrape or overload the service

5. Free Tier, Premium & Donations

Promptory is free to use with a limit on the number of prompts (free tier).
Premium subscriptions are available through LemonSqueezy (Merchant of Record). Subscription terms, billing, and refund policies are governed by LemonSqueezy's Terms of Service.
Premium features include: unlimited prompts, priority cloud sync, and future pro features.
Subscriptions auto-renew unless cancelled. You can manage or cancel your subscription through the LemonSqueezy customer portal.
Donations via DonationAlerts are entirely voluntary and are not payments for goods or services. Donations are non-refundable.

5a. Refund Policy

Refunds are handled by LemonSqueezy as the Merchant of Record.

Subscription Cancellation: You can cancel your subscription at any time through the LemonSqueezy customer portal. Cancellation stops future billing but does not provide refunds for the current billing period.
Refund Requests: All refund requests must be submitted directly to LemonSqueezy. Refunds are evaluated on a case-by-case basis per LemonSqueezy's refund policy.
No Refunds for: Donations, partially used subscription periods, or unused features after cancellation.
Processing Time: Approved refunds are typically processed within 5-10 business days.

For refund requests, please contact LemonSqueezy support through your customer portal or visit their Support Center.

5b. User Content & Copyright

You retain full ownership of all prompts you create.
By sharing to the Public Library, you grant other users a non-exclusive license to view and use your prompt.
You are responsible for ensuring your content does not infringe any third-party rights.

6. Disclaimer of Warranties

The Extension is provided "AS IS" without warranties of any kind, express or implied. We do not guarantee that the Extension will be error-free, uninterrupted, or compatible with all platforms.

7. Limitation of Liability

To the maximum extent permitted by law, the developer(s) of Promptory shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Extension, including but not limited to loss of data or prompts.

8. Third-Party Services

The Extension interacts with third-party AI platforms (ChatGPT, Claude, etc.) and uses Supabase for cloud storage. We are not responsible for the availability, terms, or policies of these third-party services.

9. Modifications

We reserve the right to modify these Terms at any time. Changes will be reflected by updating the "Last updated" date. Continued use after changes constitutes acceptance.

10. Termination

We reserve the right to suspend or terminate access to cloud features for users who violate these Terms. You may stop using the Extension at any time by uninstalling it.

10a. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the use of the Extension shall be resolved in the courts of Kazakhstan. By using the Extension, you consent to the personal jurisdiction of such courts.

If you are a consumer residing in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.
