Important: Promptory respects the intellectual property rights of others and expects users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law (including the Digital Millennium Copyright Act).
1. Overview
This DMCA & Copyright Policy ("Policy") applies to all Promptory services, including the Promptory browser extension, Public Prompt Library, and related services (collectively, the "Service").
If you believe that content within the Service infringes your copyright, please submit a DMCA takedown notice as described below.
2. User-Generated Content
The Promptory Public Prompt Library allows users to share their AI prompts with the community. By sharing a prompt to the Public Library, you represent and warrant that:
- You own all rights to the content or have explicit permission from the rights holder
- The content does not infringe any third-party intellectual property rights
- The content does not violate any applicable laws or regulations
- You have the right to grant the license described in our Terms of Service
3. Copyright Infringement Notification
If you believe that any content on Promptory infringes your copyright, please submit a DMCA takedown notice to our Copyright Agent at the contact information below. Your notice must include the following information:
- Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed
- Identification of the infringing material: A description of the material you claim is infringing, including the URL or other location within the Service
- Your contact information: Your full name, mailing address, telephone number, and email address
- Statement of good faith: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- Statement of accuracy: A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
- Physical or electronic signature: Your physical or electronic signature
4. DMCA Takedown Process
Upon receipt of a valid DMCA notice, Promptory will:
- Review the notice for completeness and validity
- Remove or disable access to the allegedly infringing content
- Notify the user who posted the content of the takedown
- Take appropriate action against repeat infringers (up to and including account termination)
5. Counter-Notice
If you believe your content was removed in error, you may submit a counter-notice. Your counter-notice must include:
- Identification of the removed material and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the federal district court for your judicial district
- Your physical or electronic signature
If we receive a valid counter-notice, we may restore the removed content after 10-14 business days unless the copyright owner files a lawsuit seeking a court order against you.
6. Repeat Infringers
Promptory has a policy of terminating the accounts of users who are repeat infringers of copyright. We reserve the right to remove any content posted by users who have been identified as repeat infringers.
7. User Responsibilities
Users of the Public Prompt Library are responsible for:
- Ensuring they have the right to share any content they upload
- Not posting content that infringes third-party intellectual property rights
- Not posting content that is illegal, harmful, or violates our Terms of Service
- Reporting any infringing content they discover on the Service
